These Terms of Service ("Terms") govern your access to and use of the Susu Lend website located at susulend.com and any related services (collectively, the "Platform") operated by Susu Lend, LLC ("Susu Lend," "we," "us," or "our"), a limited liability company organized under the laws of the State of South Carolina.
Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. About Susu Lend
Susu Lend is a financial technology platform currently operating in a limited pilot phase. The Platform allows users to submit loan applications and receive a creditworthiness evaluation using our proprietary Susu Score methodology. Susu Lend does not currently originate, fund, or disburse loans directly. Susu Lend is not a bank, credit union, or licensed lender. Submission of a loan application through the Platform does not guarantee the availability of credit or the disbursement of funds. Applicants who receive a favorable evaluation may be contacted regarding next steps as our lending program develops.
2. Eligibility
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you are at least 18 years old and that your use of the Platform does not violate any applicable law or regulation.
3. Waitlist and Pilot Program
By submitting your email address or loan application through the Platform, you are expressing interest in Susu Lend's services and joining our waitlist or pilot program. Submission does not create a binding financial agreement, guarantee access to credit, or establish a lender-borrower relationship between you and Susu Lend, LLC.
4. Susu Score and Creditworthiness Evaluation
The Susu Score is a proprietary creditworthiness evaluation tool developed by Susu Lend, LLC. It is intended to assess eligibility for future lending products based on factors including but not limited to loan purpose, employment status, living arrangement, citizenship status, and co-borrower or recommender relationships. The Susu Score is not a credit score as defined under the Fair Credit Reporting Act (FCRA). Susu Lend does not currently report to consumer credit bureaus. Results of any evaluation are for informational purposes only and do not constitute a credit decision, adverse action notice, or offer of credit.
5. Tía — AI Financial Counselor
The Platform includes Tía, an AI-powered financial counselor designed to provide general financial education and guidance. Tía is powered by third-party artificial intelligence technology and operates in English and Spanish. Tía does not provide licensed financial, legal, or investment advice. Responses generated by Tía are for informational and educational purposes only and should not be relied upon as professional financial guidance. Susu Lend is not responsible for decisions made based on information provided by Tía.
6. User Conduct
By using the Platform, you agree not to: provide false, misleading, or fraudulent information in any application or form; attempt to gain unauthorized access to any part of the Platform; use the Platform for any unlawful purpose; or interfere with or disrupt the operation of the Platform.
7. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, the Susu Score methodology, and the Tía AI counselor experience, is the property of Susu Lend, LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. "Susu Lend" is a federally registered trademark (USPTO Registration No. 7148642). "Living Credit Score" and "Susu Score" are pending trademark protection.
8. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SUSU LEND DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SUSU LEND, LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10. Indemnification
You agree to indemnify, defend, and hold harmless Susu Lend, LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Platform or your violation of these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in South Carolina.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. We will update the "Last Updated" date at the top of this page when changes are made. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
